1. PREAMBLE
AYIVOO is a digital platform operated by AYIVOO TRADING CC, enabling connections between users and independent service providers.
AYIVOO acts solely as a technological intermediary and does not provide the services offered by the service providers.
2. ACCEPTANCE OF TERMS
Accessing and using the platform implies full acceptance of these Terms of Use.
If the user does not agree with these terms, they must immediately stop using the platform.
3. DEFINITIONS
- Platform: the AYIVOO app and/or website
- User: any person using the platform to search for or book a service
- Service Provider: an independent professional offering services on AYIVOO
- Service: a service offered by a Service Provider
- Transaction: booking and payment made via the platform
4. ROLE OF THE PLATFORM
AYIVOO is a connection platform.
AYIVOO:
- does not provide the booked services
- does not guarantee the execution of services by Service Providers
- does not act as an employer, agent, or representative of Service Providers
Each Service Provider operates independently and under their sole responsibility.
5. USER ACCOUNTS
To use certain features, users may create an account.
Users must:
- provide accurate information
- secure their login credentials
- not create fake accounts
AYIVOO may suspend or delete an account in cases of fraud, abuse, or violation of the TOU.
6. BOOKING AND PAYMENT
Payments made via AYIVOO are processed through secure payment systems.
A booking becomes effective only after payment confirmation.
AYIVOO may charge a commission on transactions made via the platform.
7. CANCELLATION AND REFUND
Cancellation and refund policies depend on the Service Provider and/or platform rules.
In case of dispute, AYIVOO may intervene as an intermediary but is not responsible for the service provided.
8. USER OBLIGATIONS
Users agree to:
- use the platform legally and fairly
- respect Service Providers
- not bypass the platform to book services directly after being connected
- not commit fraud or manipulate the payment system
9. ANTI-CIRCUMVENTION
It is strictly forbidden to bypass the platform to avoid AYIVOO’s commissions or operational rules.
Violations may result in:
- account suspension
- access removal
- permanent ban from using the platform
10. LIABILITY
AYIVOO acts solely as a technical intermediary. AYIVOO is not responsible for:
- the quality of services provided by Service Providers
- disputes between Users and Service Providers
- direct or indirect damages related to booked services
11. PERSONAL DATA
AYIVOO collects and processes certain personal data necessary for the operation of the service.
Data is used for:
- account management
- booking processing
- platform improvement
AYIVOO commits to protecting data in accordance with applicable laws.
12. INTELLECTUAL PROPERTY
All elements of the platform (logo, design, content, technology) are the exclusive property of AYIVOO or its partners. Unauthorized reproduction is prohibited.
13. SUSPENSION AND EXCLUSION
AYIVOO may suspend or delete a user account in case of:
- fraud
- abusive behavior
- non-compliance with the TOU
- damage to the platform’s reputation
14. MODIFICATION OF TERMS
AYIVOO reserves the right to modify these TOU at any time.
Users will be informed of updates via the platform.
15. APPLICABLE LAW
These TOU are governed by the laws of Namibia.
Any dispute will be submitted to the competent courts at AYIVOO’s registered office after attempting amicable resolution.
